TITLE: Eldorado Responsible Dog Ownership Policy

WHEREAS, pursuant to Article II of the Declaration of Covenants, Eldorado Community Improvement Association, Inc., and Article X, Section 1 of the Bylaws of the Association, the Association has the authority to adopt and publish rules and regulations regarding the use of the Common Properties of the Association; and
WHEREAS, pursuant to Article II, Section 11 of the Declaration of Covenants, Eldorado Community Improvement Association, Inc., “at all times, dogs must be kept, restrained and controlled by their owners in the manner described in the most recent Santa Fe Animal Control Ordinance”
WHEREAS, to promote the recreation, health, safety and welfare of the residents and owners of properties in Eldorado at Santa Fe and the use and enjoyment of the Common Properties, the Board of Directors finds it necessary to further define the meaning of control and of responsible dog ownership in Eldorado at Santa Fe; and
WHEREAS, the Board of Directors desires to adopt a mandatory policy, rule and regulation of the Association reflecting the foregoing findings; and
WHEREAS, the Association’s Common Properties consist of the following:
1. Community Center Property
2. Athletic and Sport Fields
3. Stable Area
4. Greenbelts
5. Wilderness Preserve Area
6. Compadres Park
7. Bike Paths
NOW, THEREFORE BE IT RESOLVED THAT it is mandatory policy, rule and regulation of the Association that dog owners and handlers have all dogs on leash and under complete physical control (not voice control) at all times on the following Common Properties belonging to the Association:
1. Community Center Property
2. Athletic and Sport Fields
3. Compadres Park
4. Bike Paths
5. Anywhere a leash sign is posted
BE IT FURTHER RESOLVED that the Association adopts the following rules of responsible dog ownership to protect people, dogs, and wildlife in Eldorado’s Wilderness Preserve Area and Greenbelts.
Dog owners and handlers must:
1. Always restrain dogs with a leash, or by other physical means when
approaching, or when in the presence of, other people.
2. Always have dogs on lead if they do not respond immediately to voice command. A dog is considered under voice control if the dog always returns promptly to its owner’s side on the first call.
3. Carry one leash for each dog.
4. Yield the right of way to other people, including bicyclists,
equestrians, walkers and joggers by standing to the side of the trail, and holding dogs under control.
5. Have off-leash dogs within sight at all times, and close enough
that dogs can quickly and immediately be recalled when approaching
other people and wildlife. When trees or terrain obscure the line of
sight along the trail, dog owners will keep their dogs close at hand,
within 5-10 feet, to prevent unexpected encounters with other people.
BE IT FURTHER RESOLVED that the Association adopts these additional
rules of responsible dog ownership in Eldorado:
1. Do not allow any animals to persistently or continuously bark, howl or otherwise disturb the peace and quiet of the residents of Eldorado.
2. Never allow dogs to trespass on private property.
3. Always restrain pets from chasing wildlife.
4. Pick up after dogs and dispose of pet waste properly.
5. Yield the right of way to other people, including bicyclists
and joggers by standing aside and holding dogs under
control.
BE IT FURTHER RESOLVED that the Association will support an ongoing community education program to stress the importance of this policy, rule and regulation; and
BE IT FURTHER RESOLVED that the Association will actively hold members and guests accountable to honor this policy, rule and regulation; and
BE IT FURTHER RESOLVED that the ECIA will support Santa Fe County in the enforcement of the Santa Fe County Animal Control Ordinance in Eldorado. The Association will actively hold dog owners and handlers in Eldorado accountable to honor the rules and regulations set forth in the Eldorado Responsible Dog Ownership Policy; and
BE IT FURTHER RESOLVED that the Association is of the opinion that the foregoing is an important policy, rule and regulation to enforce for the health, safety and welfare of the residents of Eldorado at Santa Fe.
